Unilateral Revocation of Article 370: The Tale of India’s Betrayal towards Kashmir

Since 1947, Kashmir and its people have been suffering at the hands of India and Indian government. From brutally murdering Kashmiris to illegally detaining them and from raping their women to blinding their youth, Indian army and government both have questioned the phenomenon of human rights and the concept of humanity. Amid Pakistan’s yearning for a dialogue based solution and a peaceful settlement of Kashmir issue, India has always sidelined with the militant rather belligerent approach. The situation in Kashmir has worsened after the Burhan Wani’s killing of 2016. After that event, India marked the history of human rights abuses in the IOK (Indian Occupied Region). The situation further deteriorated after the Pulwama attack of 2018 and is still deteriorating. Using Pulwama attack as a card, BJP (Bharatiya Janata Party) regime owing to its Hindutva posture has been trying hard to suppress the people of Kashmir who have been striving for their basic human rights for decades.

Previously, IOK had been given a special status and had been administered by the Indian government but after the revocation of article 370, Kashmir has been ripped off its special status and has been subjected to the Hindutva suppression.

Recently, the Indian government has asked the tourists and pilgrims to leave Jammu & Kashmir and has even called off the Amarnath Yatra owing to the security concerns. Moreover, the Indian army has further militarized the IOK by deploying up to 35000 more troops. Not only is this, but the BJP government along with NDA (National Democratic Alliance) is striving hard to saffronize Kashmir -against the will of Kashmiris- by establishing BJP led government there. Most of the Kashmiri leadership has been detained or house arrested. In addition to this India has once again violated the LoC and has attacked the citizens of Azad Kashmir by the cluster bombs. Dr Shireen Mazari –Minister for Human Rights- has written a letter to UN High Commissioner for Human Rights Michelle Bachelet about the usage of cluster munitions by the Indian forces across LoC and the acts of violence committed by the India military. She mentioned the usage of cluster bombs that targeted citizens of Neelum Valley. She further said that India’s method of handling Kashmir goes against the international laws and obligations. She urged OHCHR to establish a commission regarding the human rights abuse in Kashmir by Indian government and military. It has been several days that India has cut all the communication in Kashmir and has even blocked the phone service, so that the voice of Kashmiris suffering a new wave of Indian militancy may not reach the world.

The insult to injury has been added by the revocation of Article 370 of Indian constitution by the Indian government. Previously, IOK had been given a special status and had been administered by the Indian government but after the revocation of article 370, Kashmir has been ripped off its special status and has been subjected to the Hindutva suppression. Jammu and Kashmir have become Union Territories by the revocation of Article 370. This act of Indian government has not only threatened the basic human rights of Kashmiris, but has also sown the seeds for future chaos. Congress and the other opposition parties have opposed the decision. India doesn’t contain the right to decide the fate of Kashmir unilaterally. By doing this India has not shown any respect towards the UN resolution related to Kashmir. Annexation of Kashmir goes against the UN resolutions.

Indian government has not only mocked democracy and the UN resolutions but it has also betrayed the Kashmiris once again.

Foreign Minister of Pakistan Shah Mehmood Qureshi while talking to a private channel said, “India has violated its commitment made in the United Nations on Kashmir issue by revoking Article 370. The Indian move to revoke Article 370 has no legal or constitutional justification. The people of Occupied Kashmir have strongly opposed abrogation of Article 370, which grants special status to them. India cannot change the public opinion through this move, and it has rather internationalized the Kashmir issue.” Furthermore, Prime Minister of Azad Jammu and Kashmir Raja Farooq Haider said, “India is carrying out propaganda against Pakistan at international level and it is high time to counter that propaganda through effective strategy. There’s a possibility of a full-blown genocide in Kashmir, but we need to stop that.” The ex-Chief Minister of IOK Mehbooba Mufti -who’s been placed under house arrest- tweeted, “Today the people of Jammu & Kashmir who reposed their faith in institutions of India like parliament & Supreme Court feel defeated & betrayed. By dismembering the state & fraudulently taking away what is rightfully & legally ours, they have further complicated the Kashmir dispute.” She even called this day as the Darkest Day for Democracy.

It’s high time for Indian leadership to shun its saffron Nazism or else the bellicosity of BJP regime will cause the blood bathing of the entire South Asian region.

It has become quite evident that Indian government has not only mocked democracy and the UN resolutions but it has also betrayed the Kashmiris once again. The report of UNHCR published in June 2018, pertaining to Kashmir narrates the tale of Hindu atrocities there, what else does the international community needs as evidence? It’s the utmost responsibility of international powers to hold India accountable of her years of human rights abuses in IOK and to pursue India to resolve Kashmir issue amicably with Pakistan. It is time for international community to help Pakistan solving the Kashmir enigma. India must learn from the 17 years’ war of Afghanistan that Kashmir issue can only be solved by negations instead of a war. It’s high time for Indian leadership to shun its saffron Nazism or else the bellicosity of BJP regime will cause the blood bathing of the entire South Asian region.
